Manch is intended for legitimate educational and training activities. Users must respect applicable law, the rights and safety of others, intellectual property, and the security and availability of the platform.
01.Purpose & Legal Framework
This Policy applies to academy owners, administrators, instructors, staff, learners, and other users who access or use Manch.
Users must comply with applicable laws, including relevant provisions of the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, copyright and intellectual property laws, and laws protecting children and other vulnerable individuals, to the extent applicable.
Manch may operate as a technology service provider or intermediary for certain activities. The precise legal obligations applicable to Manch depend on the service, the platform's role, the nature of the content, and the relevant law. This Policy does not claim that publishing it alone establishes compliance with every statutory requirement.
Academies are responsible for ensuring that their courses, teaching materials, advertisements, assessments, and other content comply with applicable law and that they hold the necessary rights and permissions.
02.Prohibited Content and Activities
Users must not upload, publish, transmit, store, stream, or distribute content or engage in activities that violate applicable law or infringe the rights of others. Prohibited content and conduct include:
- Content that the user does not own or have sufficient permission or legal rights to use and distribute.
- Content that is unlawful, obscene, sexually exploitative, or otherwise prohibited under applicable law.
- Child sexual abuse material, child exploitation, grooming, or content that sexually exploits or endangers minors.
- Content that unlawfully invades privacy, discloses sensitive personal information without authority, or distributes intimate images without consent.
- Threats, targeted harassment, incitement to violence, or unlawful discrimination or abuse.
- Fraudulent, deceptive, impersonating, or knowingly misleading material intended to cause harm or obtain an unlawful benefit.
- Content that promotes or facilitates unlawful gambling, money laundering, fraud, or other criminal activity.
- Content that unlawfully threatens the security, sovereignty, or integrity of India or violates other applicable legal restrictions.
- Malware, malicious code, phishing material, or instructions intended to compromise accounts, systems, or data.
- Any other content or conduct prohibited by applicable law or this Policy.
03.Sexual Content, Graphic Material and Protection of Minors
Manch is intended for education and training, not for hosting pornography or sexually explicit entertainment. Users must not upload or distribute pornography, explicit sexual performances, commercial sexual-service listings, or other prohibited sexual material. Content involving sexual exploitation or abuse of minors is strictly prohibited. Such material must not be uploaded, shared, stored, or accessed through Manch.
Where a report indicates an immediate risk involving unlawful sexual content, child exploitation, or serious harm, Manch may promptly restrict access, preserve relevant records, and take further action required or permitted by law.
Content that sensationalises or exploits real-world murder, severe violence, cruelty, abuse, or self-harm is prohibited where it is unlawful, exploitative, gratuitous, or inconsistent with the platform's educational purpose. Legitimate educational or professional material—for example, properly contextualised medical instruction, forensic education, public-safety training, or historical documentation—may be assessed according to its purpose, presentation, audience, and applicable law. Manch may restrict particularly graphic material or require additional safeguards. Content that encourages or glorifies self-harm or violence against others may be removed or restricted.
Users must not exploit, endanger, groom, or sexually abuse minors through the platform. They must not use courses, chat features, live classes, or other tools to facilitate unlawful contact with children. Where information gives rise to a reasonable concern about child sexual abuse or another reportable offence, Manch will assess its obligations under applicable law, including relevant reporting and cooperation requirements. Appropriate records may be preserved and reports made to relevant authorities where legally required or authorized.
Academies must comply with applicable age restrictions, classification requirements, and safeguards for educational or other material they publish. Content must not be made available to an audience where its distribution is prohibited by law.
04.Copyright, Commercial Piracy and Intellectual Property
Users must upload only content they own or are authorised to use, reproduce, adapt, host, stream, and distribute through Manch.
- Uploading commercial movies, television programmes, OTT content, or other copyrighted entertainment without the necessary rights.
- Distributing unauthorised scans of entire commercial textbooks, proprietary question banks, paid test series, or other protected publications.
- Sharing paid courses, recorded lectures, or educational materials obtained from another provider without permission.
- Uploading leaked or unlawfully obtained examination papers, answer keys, or confidential assessment materials.
- Removing or bypassing copyright notices, access controls, or other lawful rights-management measures without authorisation.
- Impersonating an author, educator, publisher, institution, or rights holder.
The use of short excerpts or other copyrighted material for a permitted purpose depends on applicable law and the circumstances. Users should not assume that an educational purpose automatically authorises the reproduction or distribution of copyrighted works.
Unauthorised examination materials may also raise issues under applicable examination laws, including the Public Examinations (Prevention of Unfair Means) Act, 2024, where its scope and requirements apply.
Rights holders may submit a notice under Section 7 of this Policy. Manch's video access controls and dynamic watermarking features, where available, are intended to reduce certain forms of unauthorized redistribution but do not guarantee prevention of copying or recording.
05.Platform Integrity and Technical Acceptable Use
Users must not misuse Manch's applications, APIs, accounts, storage, video delivery, or infrastructure. Prohibited activities include:
- Attempting to gain unauthorised access to another tenant's account, data, systems, or resources.
- Reverse-engineering or attempting to extract protected secrets, credentials, or restricted video-access mechanisms, except where legally permitted.
- Circumventing access controls, session restrictions, or security measures to access content without authorisation.
- Scraping, crawling, bulk-extracting, or harvesting platform data without permission or a lawful basis.
- Conducting denial-of-service testing, load testing, or security testing without prior written authorisation.
- Uploading malware, phishing content, malicious scripts, or payloads designed to exploit users or systems.
- Interfering with platform availability, integrity, or performance, including through automated abuse or excessive requests.
- Using Manch's infrastructure for cryptocurrency mining, unlawful distribution, or unrelated resource-intensive activity prohibited by the applicable plan.
- Sharing accounts or credentials in ways that violate access rules or create security risks.
- Circumventing subscription limits, quotas, billing controls, or authorised payment flows.
Security researchers who identify a potential vulnerability should report it responsibly to info@nausha.in and avoid accessing, altering, or disclosing customer or platform data without authorization.
06.Enforcement, Content Restrictions and Lawful Disclosure
Manch may review reports, investigate suspected violations, and take proportionate action based on the nature and seriousness of the issue, available evidence, applicable law, and risk to users or the platform.
- Requesting additional information or clarification from the reporting party or affected user.
- Removing or disabling access to violating content.
- Restricting uploads, streaming, messaging, or other affected features.
- Temporarily suspending an account or tenant while investigating a serious concern.
- Suspending or terminating an account for serious, repeated, or intentional violations.
- Preserving relevant records where appropriate or legally required.
- Reporting suspected unlawful conduct to relevant statutory authorities where legally required or permitted.
Where content appears to involve child exploitation, credible threats of serious harm, unlawful intimate imagery, or another urgent safety risk, Manch may take immediate protective action without prior notice where reasonably necessary or legally required. For other cases, Manch may seek clarification or allow the affected user to respond before making a final decision.
Serious or repeated violations may result in account termination. The effect on subscription fees, prepaid add-ons, resource allocations, and data access will be determined under the Terms of Service, Refund, Cancellation & Billing Policy, and applicable law. No provision of this Policy automatically forfeits every prepaid amount in all circumstances; any forfeiture or refund is assessed against the applicable agreement and statutory requirements.
Manch may preserve and disclose relevant information in response to valid legal process, a binding order, or another lawful request, and may make reports where required or permitted by law in accordance with statutory requirements.
